PEGASUS BIKE TOURS, LLC

A. ACCIDENT WAIVER AND RELEASE OF LIABILITY

IN CONSIDERATION of Pegasus Bike Tours acceptance of my request to participate in Pegasus Bike Tours activities, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: A) I fully release and discharge from any and all liability Pegasus Bike Tours, its members, volunteers, tour leaders, tour sponsors, tour van drivers and tour volunteers from any and all liability for any act of negligence or otherwise that might result in my death, disability, personal injury, property damage, loss of property, or any other action of any kind which may hereafter accrue to me. I freely waive any and all rights to file a claim or commence litigation against any of the entities mentioned above with respect to any claim of negligence I may have that is in any way related to my participation in this Pegasus Bike Tours activity. B) I agree to indemnify and hold harmless the entities or persons mentioned in Section A above from any and all claims made by any other individual or entity relative to my participation in this Pegasus Bike Tours activity, or any injuries, losses or damages that result from it.

 

B. ASSUMPTION OF RISK AND RIDER RESPONSIBILITIES

I ACKNOWLEDGE, agree and represent that I understand the risk of bicycling activities, which include but are not limited to, those caused by terrain, facilities, temperature, weather, equipment, vehicular traffic, the negligent or careless actions of other people including, but limited to, the entities or persons mention in Section A above, participants and volunteers. I further agree and warrant that I am voluntarily participating in these activities with the knowledge of the risks involved, and I accept and assume all known and unknown risks which might arise. If at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.

 

I ACKNOWLEDGE that I may ask Pegasus Bike Tours to transport my luggage and/or bicycle while participating in a Pegasus Bike Tour activity.  I fully release and discharge from any and all liability Pegasus Bike Tours, its members, volunteers, tour leaders, tour sponsors, tour van drivers and tour volunteers from any and all liability for any act of negligence resulting in damage or loss while transporting said luggage and/or bicycle while on a Pegasus Bike Tour.

 

I ACKNOWLEDGE that proper hydration, nutrition, training, preparation and appropriate cycling equipment are necessary for my participation in Pegasus Bike Tours Activities. I REPRESENT that my mental and physical condition, and the condition of my equipment, is adequate to allow me to safely train for and participate in Pegasus Bike Tours activities, and that no physician or other qualified person has advised me against training for or participating in such activities. I also consent to permit medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during any Pegasus Bike Tours activity.

 

I ACKNOWLEDGE that helmets are required to be used by all riders on Pegasus Bike Tours rides and that it is my duty to obey all laws, ordinances, rules and regulations. I understand that Pegasus Bike Tours shall not be required to enforce them on my behalf. If I fail to abide by such laws, ordinances, rules and regulations, I assume all risk incident thereto.

 

I HAVE READ THIS DOCUMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I UNDERSTAND THAT THIS IS A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS DOCUMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT. I FURTHER AGREE THAT THIS ACCIDENT WAIVER AND RELEASE SHALL BE CONSTRUED UNDER THE LAWS OF THE STATE OF WASHINGTON.
